Cape York Ice and Tackle or Bully’s Boat Hire and Fishing Camp referred to here with after as the Owner.
The Owner retains the right to amend accommodation and rates or itineraries, substitute vehicles and or drivers and boats as the need arises. The Owner accept no responsibility for personal expenses incurred by any passenger however caused, by or arising out of services or failure to provide services. It is recommended that adequate insurance be taken out to cover unforeseen events. The operator is not responsible for any loss, damage or theft, of luggage, personal belongings or for personal injury, accident and illness, however caused.
Entry onto the property is at all times at the risk of the entrant.
The provision of other services shall be solely in the Operators discretion.
The Owner of the hire boat / accommodation / vehicle / equipment is not responsible for any damages caused wheather personal or to any property resulting from any event or occurrence while operating/using the equipment provided. The Owner will not be liable to him or any person claiming to him or any person accompanying him for damages, loss or injury of whatever kind suffered by or through any act, default or omission wheather arising from negligence, inadvertence, accidents, or willful default or in any other way of the operator, its servants or agents in or in connection with the operating of any equipment including hire boat / accommodation / vehicle / equipment.
By accepting the services and/or signing this agreement you are authorizing Cape York Ice and Tackle to deduct from your bond being credit card or cash, appropriate monies for any damages or loss occurring to the hire boat, trailers, equipment belonging to the hire boat, vehicle, accommodation and/or any other equipment used including expenses occurring due to late return of boats, which will include the expenses of recovery for search and location, including any down time which may occur to the boats / vehicle / accommodation / other equipment.
The Owners reserve the right to charge late return fees if the boat / vehicle fail to return at agreed time. Management reserve the right to cancel a hire / accommodation agreement, and or demand boats / vehicle to return immediately, without any liability for refund. Instructions from management must be adhered to at all times without any variation. The boats are not to be left unattended at any time.
If a vehicle is provided it is made available for use of travel on the bitumen only ie supermarket, tavern, wharf after or before a normal daily hire boat day. Vehicles are to be refueled before departure or a fee will apply to refuel.
No refund will be given for days where the boats are not used, unless the Owners have been able to rehire to drive in cliental. If a booking has been made for example 5 full days boat hire, this is the payable amount. The Owner at their discretion can refuse to allow the boats to be used when the weather may create an unsafe situation. In this situation a refund will be payable.
It is advised that accommodation is locked at all times when vacant and all belongings are stored. The Owners are not responsible for any loss or thief.
Northern Peninsula Area alcohol limits
In March 2008, five communities were amalgamated as the Northern Peninsula Area (NPA) Regional Council. The Northern Peninsula Area includes the communities of Bamaga, Injinoo, New Mapoon, Seisia and Umagico.

Location:
Northern Cape York, 921 km north of Cairns and 35 kms southwest of Thursday Island. Road access is often cut during the wet season. Access by road requires a vehicle ferry crossing over the Jardine River. The traditional lands of the Injinoo people extend from the Skardon River on the west coast and Captain Billy’s Landing on the east coast up to Pajinka at the top of Cape York. The community is the homeland of most of the traditional owners of all the land on which the five Northern Peninsula Area communities are situated.

Language:
The Injinoo people comprise five major tribal groupings – Anggamuthi, Atambaya, Wuthathi, Yadhaikgana, and Gudang. Languages spoken by NPA residents include English, Torres Strait Creole, Kriol, Kalaw Kawaw Ya/Kalaw Lagaw Ya, and Mauritian Creole.

Restricted Area
The restricted area incorporates the communities that make up the NPA Regional Council area (Bamaga, Injinoo, New Mapoon, Seisia and Umagico) and includes all public and private places within these communities. It does not include Injinoo land south of Cowal Creek or Cowal Creek waterway, but includes its northern banks.
Alcohol Restrictions
The maximum amount of alcohol allowed in the NPA is limited to:
2 litres of wine (unfortified) and 11.25 litres (1 x 30 can carton) of any strength beer
OR
2 litres of wine (unfortified) and 9 litres (1 x 24 can carton) of premixed spirits of up to 5.5% alcohol/volume.
This amount is per person on foot, or per vehicle, boat or aircraft regardless of the number of people in it.
It is an offence to drink in a public place.
There are a number of licensed premises in the NPA where alcohol is sold for consumption on premises. No more than the carriage limit can be sold for take away per person or vehicle irrespective of the number of persons in the vehicle.
Tenants and owner-occupiers may apply to have their home declared a ‘dry place’ from 1 July 2008. Any current dry place declarations will lapse on this date, so a fresh application will need to be made.
Penalties
Maximum penalties for possessing illegal alcohol in the NPA are:
First Offence $37,500
Second Offence $52,500 and/or six months imprisonment
Third Offence $75,000 and/or 18 Months imprisonment.
Vehicles may also be confiscated if found carrying alcohol in excess of the carriage limit in the restricted area.
It is also an offence to attempt to bring illegal alcohol into the restricted area. The maximum penalty is $37,500.
The on the spot fine for drinking in a public place is $75 or $225 if under the age of 18. Further information on drinking in public places can be found on online at the Office of Liquor, Gaming and Racing website.
The maximum penalty for possessing alcohol in a dry place is $1,875.
These penalties apply to all people residing in, travelling through, visiting or working in the restricted area.
